New York State of Emergency

New York State of Mind...er, Emergency.  Remember how New York seems to always have a declared state of emergency (SOE) in effect that telemarketers generally ignore?  New York has started imposing significant fines on companies who made illegal calls during declared states of emergency like Covid, for example. The pandemic-related SOE ended, of course, but there are 2 technically still in effect. Not every state prohibits telemarketing calls during a declared SOE, but NY is one that does. Do you know which states have this rule? Do you know which states treat consent as an exemption and where that's a grey area? Do you know which states have the rule, but don't actually enforce it?  Do you know the potential penalties/exposure?  Ask your counsel. Take a gander at NY's proposed penalties in a current telemarketing investigation:  (ouch)
